Employers have seen a sharp rise in disability accommodation requests in the last few years — particularly for mental health-related accommodation requests. At the same time, enforcement activity and employee claims under the Connecticut Fair Employment Practices Act, the Americans with Disabilities Act and the Pregnant Workers Fairness Act continue to increase, with many cases turning not on whether an accommodation was granted, but on whether the employer properly engaged in the interactive process. 

 

Further complicating matters for employers, managers often misunderstand what conduct or communications are sufficient to trigger the obligation to engage in the interactive process, leading to compliance failures and increased legal risk.
